Interpretation

In these conditions:
  1. ‘Seller’ means Living Vogue as the seller of the goods.
  2. ‘Buyer’ means the purchaser of the goods specified herein.
  3. ‘Goods’ means the products and if any, services specified herein.
  4. Nothing in these conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Trade Practices Act 1974) and which by law cannot be excluded, restricted or modified.
Terms & Conditions - General

This website is owned and operated by Wizdom Corporation Pty Ltd, trading as Living Vogue.  ABN 28 111 436 429.  All users/browsers and buyers utilising this website are bound by the terms and conditions set out below.  Do not use this website if you do not agree with the terms and conditions and policies described below.

The information on this website is for general information only and may contain technical inaccuracies or typographical errors.  Living Vogue does not accept any responsibility for the information or accuracy provided on this website.

Use of this website and any information contained herein is at your own risk. Living Vogue will not be liable to any party for any direct or indirect consequential damages arising from use of this website or any linked websites.  Living Vogue utilises third party software, website processes and information to maintain this website and its functions and will not be held liable for any misrepresentation and reserves the right to review or cancel any order even once order is processed. 

Nothing contained on this website is intended to hold out any express or implied representation to you that any other person (including any manufacturer, designer, retailer or other organisation) has authorised or is in any way associated or affiliated with this website or the goods, products and services shown on this website or offered for sale by Living Vogue.

Refund Policy

If the buyer receives a product that they believe is not what was to be expected, please contact Living Vogue via info@livingvogue.com.au or via phone (1300 826 746) within 24 hours of receipt of goods.

If we agree that the item was not advertised correctly or within the law, or there was a mistake with the advertisement Living Vogue will replace the item or refund your money at our discretion.

Refunds will only be given once the goods have been returned to Living Vogue in original packaging and in original saleable condition by the buyer at the buyers expense.



7 Day Money Back Gaurantee Policy

If you receive any product that they are not 100% happy with,  Living Vogue will refund 100% of the value of the goods.  To act on this policy, contact Living Vogue via info@livingvogue.com.au or via phone (1300 826 746) within 24 hours of receipt of goods.  Customers will be refunded the costs of the goods minus any transport costs incurred by Living Vogue and the buyer is responsible for returning the goods to the Living Vogue warehouse
in original packaging and in original saleable condition by the buyer at the buyers expense.

Delivery Policy

Any time and dates are approximate only.  Sometimes things happen that result in unavoidable delays.   All delivery charges will be paid for by the buyer and any redelivery costs due to customer fault must also be paid for by the customer.  All prices are to the ground floor only and someone must at the delivery address to accept the delivery. If further assistance is required please contact us to arrange, extra charges will apply. All goods not collected within 14 days will be subject to a storage charge unless negotiated prior to the sale.  The buyer waives any claim for shortage of any goods delivered if a claim in respect for short delivery has not been lodged with the seller within 3 days from the date of receipt of goods by the buyer.

Shipping costs calculated by the online calculator are calculated using third party software and the seller reserves the right to review the shipping costs or cancel the order.  The buyer will be refunded any monies paid to the seller.  The seller is not liable for any loss, damage or delay occasioned to the buyer or its customers arising from late or non-delivery or late installation of the goods.  The seller may at its option deliver the goods to the buyer in any number of instalments unless there is an endorsement overleaf to the effect that the buyer will not take delivery by instalments. 

If the seller delivers any of the goods by instalments and any one of those instalments is defective for any reason:
  1. it is not a repudiation of the contract of sale formed by these conditions;
        and
  1. the defective instalment is a severable breach that gives rise only to a claim for compensation
All furniture is transported at the buyers own risk.  It is the responsibility of the buyer to arrange insurance and to organise any additional protective packaging.  Living Vogue is not responsible for the goods once they have been dispatched.

Pickup Policy

Living Vogue offer the option of pickup during business hours.  Customers wishing to pick up their item(s) must check that their items are ready for dispatch prior to arriving.  Pickups by third parties will be treated as a customer pickup and the same policy applies.  Please note that there is no transit insurance possible on items picked up.

Upon pickup the customer is expected to have the relevant invoice and ID and must sign a delivery docket and disclaimer.  The buyer waives any claim for shortage of any goods delivered if a claim in respect for short delivery has not been lodged with the seller within 3 days from the date of receipt of goods by the buyer.

Specifications & Performance

Any performance figures given by the seller are estimates only. The seller is under no liability for damages for failure of the goods to attain such figures unless specifically guaranteed in writing. Any such written guarantees are subject to the recognized tolerances applicable to such figures.  Living Vogue furniture is handmade and as such slight deviations in size, construction, colour and dimensions we allow + or - 5%.  We reserve the right to change these without prior notice.  Living Vogue take all care possible in accurately describing our products and do not take any liability for misinterpretation by the buyer.  There may be slight differences in the characteristics between the showroom furniture and that purchased due to the degree of use and natural changes caused by the manufacturing process of the components.  Inspection of the products is welcomed prior to dispatch however, in the event this option is not chosen, all liability for variances in colour, style, size and comfort is waived by the buyer. 

Our customer service team is available to answer any questions or queries you may have so please choose carefully as we are not obligated to refund or exchange if the buyer changes their mind.
 
Warranty/Guarantee
 
All goods sold by the seller are protected by the terms and conditions of the limited warranty.  The seller’s liability for goods manufactured by it is limited to making good any defects by repairing the defects or at the seller’s option by replacement.  The goods are warranted for a minimum of twelve months or the time stipulated at the time of purchase.  The time of warranty begins once the goods have been dispatched so long as:
  1. defects have arisen solely from faulty materials or workmanship;
  2. the goods have not received maltreatment, inattention or interference;
  3. accessories of any kind used by the buyer are manufactured by or approved by seller;
  4. the seals of any kind on the goods remain unbroken; and
  5. the defective parts are promptly returned free of cost to the seller.
  6. The goods have been cared for as per the warranty and care information provided
If the goods are not manufactured by the seller the guarantee of the manufacturer of those goods is accepted by the buyer and is the only guarantee given to the buyer in respect of the goods. The seller agrees to assign to the buyer on request made by the buyer the benefit of any warranty or entitlement to the goods that the manufacturer has granted to the seller under any contract or by implication or operation of law to the extent that the benefit of any warranty or entitlement is assignable.

The seller is not liable for and the buyer releases the seller from any claims in respect of faulty or defective design of any goods supplied unless such design has been wholly prepared by the seller and the responsibility for any claim has been specifically accepted by the seller in writing. In any event the seller’s liability under this paragraph is limited strictly to the replacement of defective parts in accordance with these conditions.  Any replacement will be available from the Living Vogue warehouse or location (within Australia) stated by the seller at the time of claim and any costs associated with relocating the replacement stock shall be borne by the buyer.

Except as provided in these conditions, all express and implied warranties, guarantees and conditions under statute or general law as to merchantability, description, quality, suitability or fitness of the goods for any purpose or as to design, assembly, installation, materials or workmanship or otherwise are expressly excluded. The seller is not liable for physical or financial injury, loss or damage or for consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the goods or arising out of the seller’s negligence or in any way whatsoever.

The seller’s liability for a breach of a condition or warranty implied by Div 2 of Pt V of the Trade Practices Act 1974 (other than s 69) is limited to:


in the case of goods, any one or more of the following:
  1. the replacement of the goods or the supply of equivalent goods;
  2. the repair of the goods;
  3. the payment of the cost of replacing the goods or of acquiring equivalent goods;
  4. the payment of the cost of having the goods repaired; or
in the case of services:
  1. the supplying of the services again; or
  2. the payment of the cost of having the services supplied again.
 
The seller’s liability under the s 74H of the Trade Practices Act 1974 is expressly limited to a liability to pay to the purchaser an amount equal to:
  1. the cost of replacing the goods;
  2. the cost of obtaining equivalent goods; or
  3. the cost of having the goods repaired, whichever is the lowest amount.
Cancellations
 
No order may be cancelled except with consent in writing and on terms which will indemnify the seller against all losses.  Cancellation of standard orders after a deposit or full monies are received from the buyer and prior to dispatch are subject to a cancellation charge of a minimum of 10%.  Cancellation of special orders where manufacturing has commenced and/or purchases have been made on the buyers behalf, are subject to a 50% cancellation charge.

Title of the Goods

The ownership and title of the goods remains with the seller until the seller has been paid in full for the goods under all individual contracts for the supply of the goods between the seller and the buyer.  Pending payment in full for the goods, the buyer must not supply any of the goods to any person outside of its ordinary or usual course of business.  The buyer must not allow any person to have or acquire any security interest in the goods and must insure the goods for their full insurable or replacement value (whichever is the higher) with an insurer licensed or authorised to conduct the business of insurance in the place where the buyer carries on business.  Any property of the buyer under the seller’s possession, custody or control is completely at the buyer’s risk as regards to loss or damage caused to the property or by it.

Intellectual Property

The buyer acknowledges that all intellectual property including designs, techniques, methods of manufacture, photographs, specifications, artwork, text, patented inventions and registered designs remain the property of Living Vogue and its associated companies.  The buyer will not knowingly allow any intellectual property belonging to Living Vogue to be reverse engineered, pirated or copied. Living Vogue may be entitled to compensation for any loss of royalties, damages and/or costs arising from the pirating of Living Vogue intellectual property and may pursue any body, corporate or otherwise to the full extent of the law.

Privacy Policy

Living Vogue are committed to protecting your privacy.  We may use the information gathered whilst using our website to enhance you experience and to notify you of our goods and/or services.  Living Vogue will not deliberately provide your information to third parties that are not associated with Living Vogue.  We will not knowingly disclose your information or identities unless directed by a court of law.  Living Vogue do not store any credit card information on our servers or in any other form as our payment gateways are handled by credible third parties.  Living Vogue may only release your information to anyone, company, organisation or person not related to Living Vogue when is reasonably necessary to (1) comply with law, (2) apply or enforce the terms of any of our policies or agreements, or to protect the rights, property or safety of Living Vogue, its employees, users or others as seen fit by Living Vogue.  When an order is placed through the website, we need to know your name, delivery address, email address and contact phone number to complete your order.  This privacy policy also relates to users or subscribers of our website or newsletters.  All orders are processed through a secure server utilising a secure socket layer (SSL) which encrypts all information inputted prior to being sent to us. 
 
Living Vogue may at any stage use information gathering software or ‘cookies’ which are stored by your browser on your computer’s hard drive.  These are used to process orders and to increase your experience.  They may also be used for marketing purposes.  You can disable cookies in your web browser but you will require them to use the Living Vogue website.
